The theoretical framework for the article by Sung and Richter (2007) is there are different options need to be considered for offenders entering drug treatment and leaving drug abuse treatment centers prematurely. The article points out all offenders are assessed the same way even though each drug offender has different problems and needs to be assessed on an individual bases. Also it needs to be taken into consideration why the drug abuser started using drugs and what can be done to prevent them from relapsing after their release from treatment.
Based on this article most of theses programs such as drug court, prosecutor lead program, community based program are based on Beccaria and Bentham’s classical theory method. One of the concepts in the classical theory is controlling behavior is fear, particularly fear of pain or punishment and through criminals will directed to make correct choices. The majority of criminals with drug violations do not enter rehabilitation or residential treatment at there on free will but through programs set up by the prosecutors and the courts. This is an example of how contemporary policies of today use the founding concepts of criminology to mold today’s criminal justice system.
