Sentence for Burglary Charge and Possession?
Question by Sam C: Sentence for burglary charge and possession?
Someone I know was arrested on a home burglary charge, and then arrested again a month later with possession of heroin and intent to distribute. The intent charge is being dropped, and the burglary crime was committed because of the drug addiction (which i heard makes a difference) No weapons were involved, they knew the garage code to the house because the person who lived there used to steal from their own parents, with him. He is 21, it is in Illinois and it is first offense, and he has already been in there since April but his court keeps getting postponed.
Does anyone know about how long he would be sentenced to jail?
I know this person made extremely poor decisions so please do not leave rude comments about it, thank you!

Hello Sam. This is almost a crystal ball question, but I will give a generalized thought. Having the intent to distribute dropped saved at least 5 years. Possession of heroin is a felony ( controlled substance) worth 3 to 5 years. The burglary charge is the crystal ball part. Usually there is trespassing, possibility of breaking and entering, destruction of property, the level of the theft itself ( misdemeanor or felony).
Unless the parents push the entire issue, as a first time offender, I would guess that the DA will attempt to offer a plea bargain dropping the burglary and related charges and just concentrate on the heroin charge. As such, 3 to 5 years in prison as a felony.
But this is based solely on quite a few unknown circumstances and knowledge of how most court cases go.
Best of luck and I hope this is useful to you
